The National Bank lost to former owners of Privatbank in Kyiv Appellate Economic Court and will not be able to seize Bukovel Resort, NBU press office reported to FinClub.

On May 22, the Kyiv Appellate Economic Court dismissed NBU’s appeal and upheld the decision of the Kyiv Economic Court dated 21 February on termination of mortgage agreements between NBU and Skorzonera LLC.

“The National Bank will file cassation appeal”, the press office reports.

In February, the court of first instance satisfied the lawsuit of Skorzonera LLC in NBU and terminated six mortgage agreements, concluded between the claimant and defendant as the collateral for debt liabilities of Privatbank to the National Bank on refinancing loans.

These agreements were concluded between Skorzonera and NBU in October 2014.

The subject of mortgage on agreements was the real estate (land plots), belonging to the claimant, which is located in Polyanitsa vlg, Ivano-Frankivsk region.

According to the Unified Register of Legal Entities, the former owners of Privatbank Igor Kolomoisky and Gennady Bogoliubov are the beneficiaries of Skorzonera LLC. According to YouControl data, Skorzonera LLC is the founder of Bukovel Tourist Complex.

The court found that NBU could write off the debt on refinancing from the accounts of already state-owned Privatbank, but did not do it.

The court decision says that in August 2017, National Bank claimed the claimant to repay Privatbank arrears, amounting to UAH 2.66 bln, within 30 days.

Bukovel Ski Resort was put on the books of Privatbank during the nationalization.

It should be reminded that NBU Deputy Governor Ekaterina Rozhkova stated that Privatnbank should offer non-core assets for sale: Bukovel Ski resort, 1+1 Channel building in Kyiv and the planes of International Airlines.
