The staff recommended their representatives for creditor committee.
The staff of the Odessa Oil Processing Plant had a meeting, at which his representatives were elected for the creditor committee.
“The OOPP staff representatives will become the independent participants in the bankruptcy procedure of the enterprise and will have the relevant procedural rights, including the right to appeal against any actions of other participants of this procedure”, according to the message.
In addition, the press-office reports that one more important question of the meeting was the absence of all enterprise properties in liquidation estate.
“Currently all enterprise properties, which should be in liquidation estate under the law on bankruptcy, participate in restoring solvency of OOPP PJSC, and, first of all, in backpay to working and dismissed employees of the enterprise, have been placed under the operational management of Ukrtransnaftoproduct”, according to the message.
The enterprise states that the placement of their properties under operational management “is not absolutely stipulated by the criminal procedural legislation and, consequently, is illegal.”
“In addition, Ukrtransnaftoproduct SE is the commercial enterprise, and, according to the economic code, cannot have property on the basis of operational management, which is provided for state-run enterprises. Considering that the whole integral property complex of OOPP PJSC was transferred without taking inventory and assessment of property while initiating proceeding in a case of enterprise bankruptcy, which do not satisfy the legislative requirements either, the staff is confident that the placement of OOPP PJSC properties under operational management of Ukrtransnaftoproduct SE is the illegal takeover with participation of corruption practices, in which the high-ranking officials of the state and prosecution bodies are involved”, according to the OOPP message.
The press-office also reported that in order to protect its rights the decision was taken to run protest campaign in front of the administrative building of the seized enterprise.
The campaign, which took place on August 26, did not give any results, according to OOPP.
“After the end of campaign the enterprise employees demanded that Ukrtransnaftoproduct SE officials go outside and explain, within which rights they do not return enterprises to the liquidation estate and do not let backpay employees. However, the security of the enterprise closed all doors, and nobody went outside. Nobody went outside to police officers, who arrived on call and should have clarified the situation”, as reported in the press-office message.
