State Committee for Entrepreneurship proposed the Ministry of Justice of Ukraine to clarify the issue of obtaining extracts from SSR
With the purpose of implementing the Law of Ukraine from 02.10.2010 № 5410-VI "On Amendments to Certain Laws of Ukraine on the necessity of compulsory provision of excerpts and extracts from the Single State Register of Legal Entities and Individual Entrepreneurs" the State Committee for Entrepreneurship submitted a proposal to the Ministry of Justice of Ukraine to clarify the question of obtaining extracts from the SSR, the Committee’s press service reports.
Entrepreneurs encounter difficulties in obtaining extracts from the Single State Register of Legal Entities and Individual Entrepreneurs, as notaries still require a hard-copy extract from the register.
The Law of Ukraine "On Notary" stipulates that, when checking the civil legal capacity of a legal entity, a notary must study the constituent documents and information on a given entity contained in the SSR; check whether the notarial act committed is adequate to the amount of its civil legal capacity.
This concerns only information in the SSR, not the requirement to provide extract from it, signed by the state registrar.
Should a notary have any doubt regarding the submitted documents, under the Law "On Notary", they can request from this entity, state registrar, tax and other bodies, agencies and individuals additional data or documents. At the same time a notary has access to the register and can check the information from the register independently, without asking a legal entity to provide a paper extract from the register.
