The court arrests the business center, belonging to the investment company Dragon Capital, with total area of 10.5 square meters. Interfax Ukraine reports.
According to the data of the Unified State Register of Court Rulings, the Pechersk District Court of Kyiv made the respective ruling on April 6, 2018 upon the solicitation of the General Prosecutor’s Office within the criminal proceeding, initiated in November 2017 against Irpin-Budproekt-Plus LLC.
The arrest provides for e alienation of the property.
According to the data of the Unified State Register, as of April 19, 2018, Dragon Capital Investments Limited and Dragon Capital Holding Limited were the owners of Irpin-Budproekt-Plus LLC.
As per the register’s data, the new director of Irpin-Budproekt-Plus LLC Alexander Foshchan was appointed on 26 January 2018 (the Antimonopoly Committee reported about providing Dragon Capital Investments Limited with the permission for company’s purchase on 19 January).
According to the court ruling, the abuse of office by officials of the Urban Development and Architecture Department of Kyiv State Administration and illegal provision of permission documents, which had implications, are investigated within the criminal proceeding.
In addition, the forgery and use of documents upon the conspiracy of officials of Irpin-Budproekt-Plus LLC are investigated.
The decision says that the building is the cultural heritage monument and, according to the information of the Ministry of Culture, Irpin-Budproekt-Plus LLC had only historical and urban development grounds for rehabilitation of the building of the cultural heritage monument.
Meanwhile, in 2009, KCSA provided permission to Irpin-Budproekt-Plus LLC for the design and reconstruction of the building with construction of the office complex with underground parking.
“Starting from 2011, the owner conducted construction works, as the result of which the specified object of cultural heritage was demolished, and the trade center was built on its place, while the self-governing body provided permissions for reconstruction”, according to the court ruling.
In addition, according to GPOU’s data, the company did not pay the equity participation to the city budget, amounting to UAH 4.4 mln.
Irpin-Buproekt-Plus LLC was registered in 2007.
The owners of the company, according to the state register, as of January 19, 2018 were the Cyprus Akkeron Management Limited and the British Golden Bond Limited and Evis LTD (Belize), and the final beneficiaries are Angelos Pafitis, Mikhail Postolovsky and Dmitry Yerinov.
According to the balance sheet, by the end of 2016 its fixed assets amounted to UAH 92.45 million, total assets - UAH 106.64 million.
The authorized capital of Irpin-Budproekt-Plus in 2016 increased from UAH 0.05 million to UAH 144.05 million UAH, in the same year, short-term bank loans , amounting to UAH 46 million, were repaid, and overall current liabilities decreased from UAH 101.89 million to UAH 0.24 million.
