The energy customs of SFS submitted the appeal against the ruling of Kyiv Podil District Court on cancellation of the fine, amounting to UAH 7 billion, imposed on CEO of Naftogaz of Ukraine NJSC Andrei Kobolev, Enkorr reports.
The appeal will be heard on August 15.
Reportedly, the court of first instance did not find violations in Naftogaz’s actions as the company and Kobolev as its official and close the initiated by the Energy Customs case on violating customs rules, under which the fine was imposed.
It should be reminded that the fine was imposed by Director of the Energy Customs Igor Pikovsky in February 2018. The customs accused Kobolev of not submitting the additional customs declaration with the full package of related documents when formalizing the gas import from Russia in 2015 that resulted in VAT non-payment for UAH 2.3 bln.
It refers to the procurement of natural gas from Gazprom in October 2015. Naftogaz still did not close the customs declaration on this import, as the parties did not sign the certificate of acceptance and transfer.
NAK explains that Gazprom included in this certificate those gas volumes, which are delivered without sanction by the Russian company on the uncontrolled Ukrainian territories of Donetsk and Lugansk regions. Naftogaz does not recognize these volumes and denies signing the certificate, issued by Gazprom.
It should be reminded that CEO of Naftogaz of Ukraine NJSC Andrei Kobolev appealed in Kyiv Podil District Court two resolutions of SFS Energy Customs on imposing the personal fine on him, amounting to 7 and 1.3 billion hryvnias.
CEO of Naftogaz of Ukraine NJSC stated that he is going to sue the State Fiscal Service.
