The press service of the Ministry of Justice says the Ministry proposes to reform legislation on the use of open keys infrastructure and the provision of electronic trustee services.
The relevant order that approves the concept of reform was signed by the Minister of Justice Oleksandr Lavrynovych.
The reforms are expected to create conditions for recognition of the legal status of electronic documents, certified by electronic signature, as well as Ukraine's integration into the global electronic information space.
At present, further development in this area is slowed due to lack of legal framework for the use of all capabilities of open keys infrastructure for the development and effective functioning of electronic trustee services, including electronic administrative services, electronic notary, e-procurement, electronic document management, electronic archives, electronic proceedings. Thus, public key infrastructure and digital signature are basic elements for building in Ukraine a reliable and efficient electronic document management system.
Ministry of Justice proposed the concept which involves the introduction of such new terms as "advanced electronic signature", "qualified electronic signature", "electronic stamp", "qualified key certificate", "qualified entity providing electronic trustee services." This will approximate the open keys infrastructure developed in Ukraine to its international counterparts.
It is expected to expand the list and differentiation of services using advanced electronic signature, introduce the concept of electronic trustee services, including services in electronic form on creation, testing, certification of authenticity of advanced electronic signatures, electronic time marking, delivery of electronic communications, websites authentication and services for the creation and maintenance of key certificates for advanced electronic signatures, etc.
According to the concept, the process of reforming the open keys infrastructure and services for qualified electronic trustee services in Ukraine will take up to 5 years.
As a result, proper conditions for the use of the full functionality of open keys infrastructure, its standardization and development of electronic trustee services for effective e-governance will be created in Ukraine. Among them - to provide administrative services in electronic form, introduction of electronic notariat, massive use of electronic documents, further intensive development of e-justice, e-procurement, electronic archives, etc..
In addition, there are also plans to create the conditions for the recognition of foreign qualified public key certificates and qualified electronic signatures in Ukraine, which will foster active development of transborder cooperation and integration of Ukraine into the global electronic information space.
