Procedure for wholesale and retail trade in vehicles amended

Cabinet’s Resolution No. 243 of 03.04.2013 amended the Procedure for wholesale and retail trade in vehicles and their component parts with identification numbers.

In particular, it is established that accounting for receipt, selling and transfer of vehicles and their parts bearing identification numbers is conducted by economic entities in written and electronic form. Economic entities promptly submit information on the receipt, transfer, sale of motor vehicles and their parts with identification numbers into electronic registry. Electronic register is an automated information retrieval system for keeping record of economic entities engaged in wholesale and retail trade in motor vehicles and their component parts bearing identification numbers, accumulating information on the receipt, transfer, sale of vehicles and their components bearing identification numbers, issue and use of blank products, license plates for single trips and "Transit" license plates.

It is also determined that forms of bills of sale, certificates of acceptance, number plates for single trips and "Transit" license plates are not considered documents of strict accountability.

The Resolution is supplemented with the norm, which stipulates that the registration of contracts of sale of vehicles can be done in the State Automobile Inspectorate. Revised Procedure provides for accepting on commission the vehicles and their component parts bearing identification numbers that have been registered or removed from the register at the State Automobile Inspectorate or machines removed from the register in the State Agricultural Inspectorate for their further implementation: from citizens of Ukraine having the passport of a citizen of Ukraine or temporary certificate of citizen of Ukraine, the certificate of registration of the vehicle (registration certificate) or car registration certificate, certificate of inheritance, court decision or certificate for the component part which bears the identification number issued by the State Automobile Inspectorate or the State Agricultural Inspectorate.

Component parts bearing ID numbers on the basis of documents confirming the legality of their acquisition may be accepted on commission. From economic entities - having the invoice specifying the model, brand of the vehicle, number of chassis, engine, its price, vehicle registration certificate, passport and power of attorney of the entity’s authorized person.

Vehicles or machines, in the prescribed manner reported for the seizure or prohibition on removal from the register, not registered with the State Automobile Inspectorate or State Agricultural Inspectorate and vehicles for which a registration certificate was not issued, are not accepted on commission.

It is also stipulated that on all sold vehicles and components bearing ID numbers a commissioner must give the buyer:

- for vehicles registered with the State Automobile Inspectorate – vehicle registration certificate, for vehicles removed from the register – license plates for single trips;

- for vehicles registered with the State Agricultural Inspectorate and removed from the register - registration certificate of the vehicle and components bearing ID numbers, or certificate of technical condition of machines (tractors, self-propelled chassis, self-propelled agricultural, road-building and irrigation machinery, farm machinery and other mechanisms) and their components which have ID numbers, "Transit" license plates.

In addition to the said documents it is also necessary to issue a service book (warranty card), bill of sale, settlement document confirming the purchase of vehicles.
