Resolution of the Cabinet of Ministers of 02.10.2013 №727 takes effect
Resolution in force imposes administrative responsibility on traders for denying the consumer’s possibility to pay for goods or services electronically, the press service of State Committee for Entrepreneurship informs.
According to the Cabinet Resolution of 02.10.2013 № 727 "On Amendments to paragraph 2 of the Regulation on the imposition and collection of fines for violation of legislation on consumer protection" of 02.10.2013 № 727, the restriction or denial of the rights of consumers of free choice of products and forms of payment entails the fine of five hundred nontaxable minimum incomes, that is 8500 UAH.
So now consumers can require all business entities that have cash registers to accept payment in electronic form. When denied to make the payment electronically, consumers can seek protection with the State Inspection of Ukraine on protection of consumer rights.
Under Article 16313 of the Code of Ukraine on Administrative Offences, for failure to comply with the legislative requirements enabling payment for goods (services) through electronic payment facilities, bodies of revenue and duties may impose on entrepreneurs a fine from 100 to 200 NMIC (1700-3400 UAH), with repeated violation within one year - from 500 to 1000 NMIC (8500-17 000 UAH).
The ordinance is designed to bring the Regulation on imposition and collection of fines for violation of legislation on consumer protection, approved by the Cabinet of Ministers of 17.08.2002 № 1177, in line with the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on the functioning of payment systems and promotion of non-cash payments».
