The Verkhovna Rada of Ukraine has adopted the law on Protection of Economic Competition (on enhancing efficiency of control system over economic concentrations). According to parliament press-service, 287 people’s deputies have voted for the relevant draft law №2168a, UBR reports.

This draft law stipulates the increase of threshold indicators, for which it is required to obtain permission of the Antimonopoly Committee (AMCU) for concentration of companies.

Pursuant to new requirements, obtaining the preliminary AMKU permission on concentration will be necessary in that case, if the aggregate cost of assets or the aggregate volume of sale of goods of participants of concentration with account of control ratio for the last financial year (including, abroad) exceeds the amount equivalent to EUR 30 mln (as per NBU rate, effective on the last day of financial year), and the cost of assets or volume of sale of goods in Ukraine, which not less than two participants of concentration have, with account of control, exceeds the amount, equivalent to EUR 4 mln (as per the same NBU rate).

In addition, obtaining AMCU permission on concentration is necessary, if the aggregate cost of assets and the volume of sale of goods in Ukraine of at least one participant of concentration with account of control ratio for the last financial year exceeds the amount, equivalent to EUR 8 mln (as per the same NBU rate), and the volume of sale of goods of at least one from other participants of concentration with account of control ratio for the last financial year, including abroad, exceeds the amount, equivalent to EUR 150 mln (as per the same NBU rate).
