NSSMC (National Securities and Stock Market Commission) adopted the decision at the meeting, which took place on the 17th of November 2015, on revoking the license of PJSC “Ukrainian Exchange” for conducting professional activities on stock market – activities on trade organization on stock market, as it is said in the NSSMC press-release, RBC-Ukraine reports.

It is noted that the decision was adopted in compliance with requirements of the paragraph 9 of the article 16 of Law of Ukraine on Licensing Types of Business Activities, according to which the grounds for revoking license is the documented evidence for establishing facts of control (decisive influence) over the activities of licensee of entities of other countries, committing armed aggression against Ukraine.

As per request of the Commission, Ukrainian Exchange has provided the information on the structure of owners, as per which 22.44% of shares of PJSC “Ukrainian Exchange” belong to JSC “Moscow Exchange MICEX-RTS” (Russian Federation), 20.64% of shares belong to PJSC “Ukrainian Exchange Holding”, the 100% shareholder of which is “Moscow Exchange MICEX-RTS”.

Previously the potential buyers of shares of Ukrainian Exchange, which belong to the Russian shareholder, “Dragon Capital” and “Univer Capital”, have provided the Commission with information on the possibility of purchase of these stocks of shares. Within six weeks the Commission has been expecting for specific results on changing the structure of owners of Ukrainian Exchange, but the parties have not demonstrated the corresponding progress.

The decision comes into force in 30 calendar days. The NSSMC decision can be appealed against in the Licensing Advisory and Appeal Board of the State regulator service of Ukraine and/or judicial authority.
