S. Batryn files a lawsuit to the Supreme Administrative Court
Lawyer Stanislav Batryn appealed to the Supreme Administrative Court of Ukraine with a lawsuit against the President of Ukraine Viktor Yushchenko, as reported by the plaintiff himself.
In particular, the statement reads as follows:
«We appealed to the Supreme Administrative Court of Ukraine with a lawsuit against the President of Ukraine V. Yushchenko and express doubt regarding the legitimacy of the President's actions prohibiting O. Dubyna as head of «Naftogaz of Ukraine» to sign gas contracts at the price $235.
We also consider as unlawful V. Yushchenko's actions regarding assuming powers of the Cabinet of Ministers of Ukraine and exercising management influence on «Naftogaz of Ukraine» (abuse of authority in view of art. 19 of the Constitution of Ukraine) when concluding contracts for the supply and transit of gas under № CP and № TKHU, issuance of binding guidelines to the company «Naftogaz of Ukraine».
We ask the court:
1. Declare the actions of President of Ukraine V.A. Yushchenko regarding assuming powers of the Cabinet of Ministers of Ukraine and the Ministry of Fuel and Energy of Ukraine and exercising management influence on «Naftogaz Ukraine» in negotiating and concluding contracts for the supply and transit of gas between «Naftogaz Ukraine» and OJSC «Gazprom» in 2008 as unlawful.
2. Declare the actions of President of Ukraine V.A. Yushchenko regarding the issuance of directives obligatory for execution by «Naftogaz Ukraine» (approved by the Decree the President of Ukraine on 26 February 2008 № 165/2008) with the relevant terms for making and content of the contracts for the supply and transit of gas between «Naftogaz Ukraine» and OJSC «Gazprom» in 2008 - 2009, as unlawful.
3. Declare the actions of President of Ukraine V.A. Yushchenko regarding recall of the Chairman of the Board «Naftogaz Ukraine» and prohibition to sign the contract intergovernmentally agreed by Ukraine and Russia as at 30-31.12.2008 for gas supply between «Naftogaz Ukraine» and «Gazprom» at $235 per 1 thousand cubic meters, as unlawful.
4. Declare unlawful (illegal) and cancel the President of Ukraine’s Decree of 26 February 2008 № 165/2008 that approves mandatory for execution directives of the President of Ukraine Viktor Yushchenko».
